CAK Clarifies on earlier reports on recruitment of new Director General


Outgoing Communications Authority of Kenya (CA) Director General Francis Wangusi will remain in office even after his term ends. This is after a Court battle that is pending hearing.

Mr Wangusi’s term ended last week, and a new CA boss was to take over but he will stay in office over emerging illegality in the appointment of  Mercy Wanjau as the new CA boss.

In a letter released to media houses today,the  Board Chairman wrote the following ;

The attention of the Communications Authority of Kenya (CA) has been drawn to media
reports, misrepresenting court orders issued earlier today relating to Petition No. 155 of 2019
on the recruitment into the Office of the Director General.

This is to confirm that the matter came up at the Employment and Labour Relations Court
today, Tuesday 27th August 2019. The Court ordered and gave directions that the “status quo”
relating to the recruitment of the Director General be extended. The Court specifically
pronounced itself on the import and effect of the order of status quo, to mean that it was
in relation to recruitment of the Director General and not the extension of the term of
office of the former Director General.

Consequently, the recruitment process will remain on hold as directed by the Court.
Meanwhile, with the lapse of the term of the immediate former Director General on 21st
August 2019, Mrs. Mercy Wanjau will continue to discharge the duties of the Office on
interim basis.

The matter will be mentioned before the duty judge on 10th September 2019 along with
another related matter i.e. ELRC Petition Number 138 of 2019 Okiya Omtatah Okoiti &
others vs A.G & others.
